Student Records. With respect to any access by Ifrit Technologies LLC to any "education records" (as such term is defined in the Family Educational Rights and Privacy Act, 20 U.S.C. $ 1232 et seq. ("FERPA")) held by Customer under or in connection with this Agreement, Ifrit Technologies LLC shall be acting as a legal agent ("school official") of Customer. As between the Parties, any information protected by FERPA submitted to Ifrit Technologies LLC by Customer in connection with this Agreement shall be deemed the Confidential Information of Customer. Ifrit Technologies LLC agrees to comply with FERPA and agrees not to share or disclose any FERPA protected information with any third party except as permitted by FERPA or as authorized or permitted by Customer.

Ifrit Technologies LLC and Customer each represent and warrant that it will comply with Children's Online Privacy Protection Act (COPPA) and the Children's Internet Protection Act (CIPA), to the extent such laws are applicable to the respective party's actions under the Agreement. Customer shall be responsible for establishing or requesting that Ifrit Technologies LLC establish student accounts for access to the Ifrit Technologies LLC and shall ensure that it has obtained any necessary and appropriate consent from students to establish such accounts; Ifrit Technologies LLC will not establish any student accounts except as directed by Customer. The parties agree that Ifrit Technologies LLC may rely on Customer to obtain the necessary and appropriate consent from students for such students use of or access to Ifrit Technologies LLC.
We do not market specifically to children under 13, nor do we do we allow third-parties, including ad networks or plug-ins collect PII from our users, including those under 13.

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. We are committed to the Student Privacy Pledge. Our main commitments are:

  1. We will collect, use, share, and retain student personal information only for purposes for which we were authorized by the educational institution/agency, teacher or the parent/student.
  2. We will not sell Student Personally Identifiable Information (PII).
  3. We will not use or disclose student information collected through an educational/school service (whether personal information or otherwise) for behavioral targeting of advertisements to students.
  4. We will not build a personal profile of a student other than for supporting authorized educational/school purposes or as authorized by the parent/student.
  5. We will not make material changes to School Service Provider education privacy policies without first providing prominent notice to the users and/or account holder(s) and allowing them choices before data is used in any manner inconsistent with terms they were initially provided.
  6. We will not knowingly retain Student PII beyond the time period required to support the authorized educational/school purposes, or as authorized by the parent/student.
  7. We will disclose clearly in contracts or privacy policies, including in a manner easy for institutions and parents to find and understand, what types of Student PII we collect, and the purposes for which the information we maintain is used or shared with third parties.
  8. We will support access to and correction of Student PII by the eligible student or their authorized parent, either by assisting the educational institution in meeting its requirements or directly when the information is collected directly from the student with student/parent consent.
  9. We will maintain a comprehensive security program that is reasonably designed to protect the security, confidentiality, and integrity of Student PII against risks – such as unauthorized access or use, or unintended or inappropriate disclosure – through the use of administrative, technological, and physical safeguards appropriate to the sensitivity of the information.
  10. We will require that our vendors with whom Student PII is shared in order to deliver the educational service, if any, are obligated to follow these same commitments for the given Student PII.
  11. We will allow a successor entity to maintain the Student PII, in the case of our merger or acquisition by another entity, provided the successor entity is subject to these same commitments for the previously collected Student PII.
